AGREEMENT BETWEEN USER AND AUSSIE HUNTING ADVENTURES TV

The Aussie Hunting Adventures website is comprised of various Web pages operated by Aussie Hunting Adventures.

The Aussie Hunting Adventures website is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Aussie Hunting Adventures website constitutes your agreement to all such terms, conditions, and notices.

COMPETITIONS

Information on how to enter forms part of the terms of entry. Entry into the Aussie Hunting Adventures TV (“Competition”) is deemed acceptance of these terms and conditions.

Eligibility to Enter

Entry is open to all residents of Australia who are 12 years of age or over. However, employees and the immediate families of A.H.A Productions Pty Ltd (the “Promoter”) and their associated agencies and companies or any organisation or individual associated with the provision of the prize(s) are not eligible to enter. Some prizes may be subject to minimum age and or license requirements. Proof of identity, age and license will need to be supplied where required.

Competition Period

The competition commences on Saturday 4th July 2016 at 09:00am AEST and closes on Monday 21st Dec 2016 at 12:00AEST(“Competition Period”)

The Competition will be advertised on, but not limited to, C31 – community networks around the country and foxtel, www.ahatv.com.com.au, AHA TV Social media platforms.

How to Enter:

To participate in the Competition entrants must log on to ahatv.com.au, follow the links and register their details including (but not limited to) name, address, phone number, email address, gender and interest.

General:

- Prizes are subject to change without prior warning.

- Prizes are supplied on a non-exchange basis and are not redeemable for cash.

- First prize – trip to Africa with Bushveld Hunting Adventures excludes transfers, airline taxes, surcharges, excess luggage, taxidermy and shipment of trophies, customs fees, spending money, accommodation prior to or after your safari and tips to PH and camp staff. Flights to the maximum of $1500.00, if in such an event the the airfare is more than the above mentioned amount, this will be the responsibility of the “winner” of that prize.

- All decisions made in relation to the mentioned above and not limited to the AHA TV prize pool; are final and no correspondence shall be entered into.

- Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

- For purposes of public statements and advertisements The Promoter will only publish the winner’s surname, initial and State. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.

- Your consent to The Promoter collecting your personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying the winner and prize fulfilment). Your personal information may be disclosed to third party service providers for this purpose.

- The Promoter is A.H.A Productions Pty Limited (ABN: 39 162 440 511) of Langwarrin, 3910 Victoria.

MODIFICATION OF THESE TERMS OF USE

Aussie Hunting Adventures reserves the right to change the terms, conditions, and notices under which the Aussie Hunting Adventures website is offered, including but not limited to the charges associated with the use of the Aussie Hunting Adventures website.

The Aussie Hunting Adventures Web Site may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Aussie Hunting Adventures and Aussie Hunting Adventures is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Aussie Hunting Adventures is not responsible for webcasting or any other form of transmission received from any Linked Site. Aussie Hunting Adventures is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Aussie Hunting Adventures of the site or any association with its operators.

NO UNLAWFUL OR PROHIBITED USE

However, Aussie Hunting Adventures reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Aussie Hunting Adventures reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Aussie Hunting Adventures reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Aussie Hunting Adventures sole discretion.

TERMINATION/ACCESS RESTRICTION

Aussie Hunting Adventures reserves the right, in its sole discretion, to terminate your access to the Aussie Hunting Adventures Website and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in San Mateo County, California, U.S.A. in all disputes arising out of or relating to the use of the Aussie Hunting Adventures website. Use of the Aussie Hunting Adventures website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Aussie Hunting Adventures as a result of this agreement or use of the Aussie Hunting Adventures website. Aussie Hunting Adventures performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Aussie Hunting Adventures right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Aussie Hunting Adventures website or information provided to or gathered by Aussie Hunting Adventures with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Aussie Hunting Adventures with respect to the Aussie Hunting Adventures website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Aussie Hunting Adventures with respect to the Aussie Hunting Adventures website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.
